Rett til ferie
Ferieloven gir alle arbeidstakere rett til ferie, og de aller fleste har en avtalefestet rett til fem ukers ferie.
Loven definerer en arbeidstaker som «enhver som utfører arbeid i annens tjeneste». Selvstendig næringsdrivende er ikke omfattet av ferieloven.
For å ha rett til full ferie samme år, må du ha begynt i jobben senest 30. september. Har du begynt etter 30. september, har du bare rett til én ukes ferie det første året.Dette sier loven, men hos oss trekkes du 2,08 dager hver måned fordi vi har 12 månederslønn pluss feriepenger. Det betyr at du i juli kan ta ut 2,08 dager x 7 mnd = 14,6 . I august : 2,08 dager x 8 mnd = 16.6 dager
Ferieloven sikrer deg rett til ferie i minimum 4 uker og én dag pr. år. De aller fleste har imidlertid en avtalefestet rett til fem ukers ferie.(det har vi ) Arbeidstakere over 60 har rett på én ukes ekstra ferie, fra det året de fyller 60 år.
For mange er dette regulert i tariffavtaler arbeidsgiver er bundet av. Men for noen vil dette framgå enten av den enkeltes arbeidsavtale, eller av den ordning arbeidsgiver praktiserer i virksomheten (ofte tatt inn i virksomhetens personalhåndbok).
Hvor lang ferie har du rett til?
Både lov, tariffavtale og din egen arbeidsavtale kan angi hvor lang ferie du har rett på. Tariffavtale eller individuell arbeidsavtale kan likevel ikke medføre at du får kortere ferie enn det loven gir rett til.
Lovfestet ferie
Etter ferieloven har du rett til ferie i 25 virkedager. Ferieloven regner lørdagen som virkedag og 6 virkedager tilsvarer dermed én uke ferie. Til sammen gir ferieloven rett til 4 uker og én dag ferie.

Kan arbeidsgiver nekte deg å ta ut lovpålagt ferie?
Nei, arbeidsgiver plikter å sørge for at arbeidstaker gis ferie hvert ferieår.
Tariffestet ferie
I forbindelse med tariffoppgjøret år 2000 fikk mange grupper rett til en femte ferieuke. Feriepengene beregnes da med 12%.
Avtalefestet rett til lengre ferie
Noen arbeidstakere har gjennom egen avtale rett til lengre ferie enn loven gir. Denne kan være finansiert på samme måte som den tariffestede, ved at det beregnes feriepenger etter en høyere feriepengesats. Den kan også være finansiert på den måten at avtalen gir deg rett til en ukes ekstra ferie, uten at du trekkes i lønn.

Ekstra ferieuke når du fyller 60 år
Alle arbeidstakere som fyller 60 år i løpet av ferieåret, har rett til en ekstra ferieuke etter ferieloven. Den ekstra ferieuken finansieres ved at prosentsatsen for beregning av feriepenger forhøyes med 2,3%.
Hvis du tjener mer enn 6G – beregnes likevel ikke feriepenger etter denne forhøyede satsen for den del av lønnen som overstiger 6G. (Grunnbeløpet G endres hver 1. mai. Per 1. mai 2025 ble grunnbeløpet satt til 130 160 kroner slik at 6G er 780 960 kroner.)
Noen har egne ordninger eller er omfattet av tariffavtale som sikrer full dekning også for inntekt som overstiger 6G. Her må du sjekke nærmere med din arbeidsgiver hvilke ordninger de har der du jobber.

Vacation and Holiday Rules
We see that the company is now sending out information about registering vacation. Let’s take a look at what the law says about vacation.
Right to Vacation
The Norwegian Holiday Act grants all employees the right to vacation, and the vast majority also have a contractual right to five weeks of vacation.
The law defines an employee as “any person who performs work in the service of another.” Self-employed individuals are not covered by the Holiday Act.
To be entitled to full vacation in the same year, you must have started your employment no later than September 30. If you start after September 30, you are only entitled to one week of vacation during your first year.
This is what the law says, but in our company you are deducted 2.08 days per month because we have a 12-month salary system plus holiday pay. This means that in July you can take 2.08 days × 7 months = 14.6 days. In August: 2.08 days × 8 months = 16.6 days.
The Holiday Act guarantees the right to at least 4 weeks and 1 day of vacation per year. However, most employees have a contractual right to 5 weeks of vacation (which we do). Employees over the age of 60 are entitled to one additional week of vacation from the year they turn 60.
For many employees, this is regulated through collective bargaining agreements to which the employer is bound. For others, it may be specified in the individual employment contract or through company practice (often described in the employee handbook).
How Much Vacation Are You Entitled To?
The law, a collective agreement, and your individual employment contract may all specify how much vacation you are entitled to. However, neither a collective agreement nor an individual employment contract may reduce your vacation entitlement below the minimum provided by law.
Statutory Vacation
Under the Holiday Act, you are entitled to 25 working days of vacation. Saturdays are considered working days under the Act, meaning that 6 working days equal one week of vacation. This gives a total entitlement of 4 weeks and 1 day of vacation.
Can an Employer Refuse You to Take Statutory Vacation?
No. The employer is obligated to ensure that employees take vacation every holiday year.
Contractual Vacation Through Collective Agreements
As part of the collective bargaining settlement in the year 2000, many employee groups gained the right to a fifth week of vacation. In these cases, holiday pay is calculated at 12%.
Contractual Right to Longer Vacation
Some employees have an individual agreement that grants more vacation than the law requires. This may be financed in the same way as collectively agreed vacation, through a higher holiday pay percentage. It may also be financed by granting an extra week of vacation without any salary deduction.
Additional Vacation Week When You Turn 60
All employees who turn 60 during the holiday year are entitled to one additional week of vacation under the Holiday Act. This additional week is financed by increasing the holiday pay percentage by 2.3%.
If you earn more than 6G, holiday pay at the increased rate is not calculated on the portion of salary exceeding 6G. (The National Insurance basic amount, G, is adjusted every May 1. As of May 1, 2025, the basic amount was NOK 130,160, making 6G equal to NOK 780,960.)
Some employers have separate arrangements or collective agreements that provide full coverage for income exceeding 6G. Employees should check with their employer regarding the arrangements applicable at their workplace.
